Electronic Mail Policy —

Use of our server(s) for any purposes without our express permission
is a violation of multiple national and international statutes. More specifically,
the sending of, or attempting to send, unsolicited email messages to this server is
a violation of Section 326, 342.1, and 380 of the Canadian Criminal Code, and
18 U.S.C. 1030 and 18 U.S.C. 2511 of the United States Criminal Code, and will
result in the imposition of both civil and criminal liability against you.
Notice to all commercial, bulk, junk, and other spam emailers —
We have a zero-tolerance policy regarding unsolicited email.
Our mail servers are private property — we are the sole authority
for allowing others to use our servers as we see fit, and as such we determine
what incoming mail from other mail servers we wish to accept or allow in.
Any other access without our permission is considered trespassing.
Any and all unsolicited email sent to our server is subject to processing charges
billable to both the sender and originating internet service provider, and possible
criminal prosecution at our sole discretion.
Your use of our electronic mail services by way of any email you send
to our mail servers automatically constitutes your complete and unconditional
acceptance of the terms of usage and associated service fees which we impose,
as described herein.
- If you send unsolicited email to any of the email accounts hosted on this
server, be advised that you will be billed for processing and storage services
at a rate of $10,000.00 U.S. per email message. This applies to every
piece of unsolicited email.
- Electronic probing of our email server will be assessed a server
connection access fee of $10,000.00 U.S. per probe. In addition, we may
initiate criminal prosecution against anyone caught engaging in any such activity.
- We have NOT submitted our email addresses to any opt-in or opt-out mailing
lists. Therefore we do not reply to be removed from lists to which we most
certainly have not subscribed.
- Apologies for 'bothering' us, or 'inadvertently including' us in your
emailings, are NOT acceptable, and DO NOT excuse you from your obligation to
pay the applicable service fees.
- ALL unsolicited email access is invoiced either directly to the source,
or indirectly to the originating/host ISP.
- We reserve the right to change our service charges or other aspects of our
electronic mail usage policy without notice.
- Our server rejects email from known spamming sources, including entire IP
address ranges from known spamming domains.
If you find that your email is bounced or rejected, your ISP is most likely among
those blacklisted. We suggest you switch to an alternate email service provider,
as once a spammer domain/IP is added to our list of prohibited email sources, it
is highly unlikely that it will be removed.
CAUTION
We utilize Active Defense tools against those
who choose to ignore our rules — namely, no spamming, no probing, no hacking, no intrusion into OUR
PRIVATE COMPUTER SYSTEM. Our server engages in VERY aggressive anti-spam activities
if it detects unsolicited incoming email sent to our server(s).
We will NOT be responsible for any damage and/or disruption of your email,
server(s), computer(s), &/or network as a result of our server's retaliatory
response to YOUR unsolicited spam email.
If you do not wish to be subjected to electronic countermeasures against your
computer(s), server(s), and/or network(s), simply do NOT
send us any unsolicited spam email. YOUR ACTIONS
in sending us any and all unsolicited spam email constitutes
YOUR UNCONDITIONAL ACCEPTANCE of any and all
retaliatory response/actions we may take against you, your server(s),
and/or your network(s).
IF YOU PROBE OUR NETWORK(S),
BE ADVISED OUR COUNTERMEASURES
MAY INCLUDE BROAD-SPECTRUM SCANNING OF YOUR NETWORK(S).
Note: Under Federal law it is legal for copyright holders to
implement technological measures to defend their intellectual property. Our business,
products, website, trademarks, and email address(es) are corporate assets and are
our intellectual property, and as such we will pursue all technological avenues
available to us to ensure compliance with our posted terms of usage policies.
